DUI repeat offenses- Ft Lauderdale/Miami attorney

  If you  are facing a second or third DUI, prosecutors will generally be arguing for jail time. Even on a first DUI a defendant can face up to 180 days in jail. Most of the time, for first offenses we are able to negotiate plea bargains that require probation instead of jail.
If you have a second DUI within the past 5 years, Florida law requires a mandatory ten days jail time, and often times depending on the facts of the case, the Fort Lauderdale DUI prosecutors will seek 20 – 40 days in jail, or even longer.
For a third DUI within 10 years the legislature mandated minimum sentence is 30 days in jail. The prosecution will often seek 60 – 364 days in the county jail for a misdemeanor, or file felony charges that will result in a prison sentence.
