Fort Lauderdale DUI Lawyer – Miami Criminal Attorney

If you or a loved one has been arrested for a Felony in Miami Dade County, the hiring of a Miami Criminal Lawyer in the early stages of the case is essential. When someone is arrested, they often think the charges they were arrested for are what they will be charged with in court. This is not always the case.

The Miami State Attorney’s Office has a pre filing unit that specifically reviews every Felony arrest to see if the charges have merit. This is where a knowledgeable Miami Criminal Lawyer comes into play. We are able to establish contact with the lawyer that will be reviewing the file. Once contact is established, a good Miami Criminal Lawyer will then prepare a detailed memorandum stating the facts of the case from the Defendant’s point of view. In addition, the memorandum will include legal arguments as to why the State Attorney should not file charges. Sometimes pictures, letters of recommendation and other exhibits are helpful as well.

There is no better way to dispose of a Miami criminal case than to have the State Attorney announce a “No Action” on the file. This means that the case will not be filed and the Defendant will not be prosecuted at that time. The Defendant is then free to leave and will be able to get their bond back without any court costs. It is still possible the State Attorney will choose to file the case at a later time if new information evolves, but most times once a “No Action” has been announced, the case is over.
