In a high profile case, a Miami commissioner was recently found not guilty in a DUI case. Consider a recent article for NBC Miami titled “Miami-Dade Commissioner Jose ‘Pepe’ Diaz Found Not Guilty in Key West DUI Case.”
The author of the article writes, “Miami-Dade Commissioner Jose ‘Pepe’ Diaz has been found not guilty in his Key West DUI case. Jurors heard closing arguments Wednesday before quickly deliberating the case. ‘I want to start out by thanking God, this has been quite a roller coaster, it’s very emotional,’ Diaz said after Wednesday’s hearing. Diaz had pleaded not guilty to the DUI charge, which stemmed from his arrest this past October. Key West police said Diaz was arrested after he stopped his Harley-Davidson motorcycle and it fell down because he failed to put the kick stand down. Diaz reportedly was doing 74 mph in a 30 mph speed zone before he was stopped. Police said they placed him in handcuffs after he failed field sobriety tests, which included swaying during an eye test and losing his balance while trying to walk a straight line.”
Local 10 also takes a look at this case in a recent article titled “Miami-Dade County Commissioner Jose ‘Pepe’ Diaz not guilty of DUI.” Michael Seiden of Local 10 writes, “Diaz was arrested in September after he was pulled over for speeding while riding his motorcycle in Key West. ‘You’re going to tell me, ‘Right. Left. Touch the tip of my nose right here,’’ Diaz said in the video before falling over. The video played in court in front of the jury and Diaz’s wife and daughter. Diaz admits that he had two drinks earlier at a pool party, but insists that his blood-alcohol level was not over the legal limit. On at least two separate occasions, the arresting officer asked Diaz if he wanted to take a breathalyzer, but he refused. Police said he also refused a third time at the police station.”
