Will You Receive A Higher Payout When You Use A Personal Injury Attorney?

Special Report:

Florida Car Accident Attorney Reveals Special Report on How Hiring a Personal Injury Lawyer for Your Insurance Claim Can Put More Money In Your Pocket

If you or your loved one is injured in an accident due to the negligence of another driver or company, you are going to be dealing with an insurance company.  Reports we have gather show that your own insurance company and all other insurance companies are trying to hide vital information they don’t want you to know.

In this Special  Report, We Uncover the Insurance Industry Secrets . . .

Insurance Industry Studies Prove That a Personal Injury Attorney Can Get You More Cash for Your Claim than You Can Get by Yourself

Insurance companies don’t want you to have your own lawyer involved in any settlement offer they might bring you.  Even your own insurance company wants to keep you from getting representation. The claims agent’s job is to settle your claim as quickly and as cheaply as possible.  Their boss and the company’s shareholders make more money that way.  Their gain is your loss.

Many times the claims agent will simply tell you that “you don’t need an attorney.”  Just like the cop who tells the suspect he doesn’t need a lawyer.  The agent and the insurance company are not your friend, no matter how nice they might seem. They are betting you will not know your rights or the law, and that you will not know how to negotiate your claim.  Studies prove that if they can convince you not to hire an attorney to protect you throughout the process, they will have a lower payment for your claim.

Independent studies and the insurance industry’s own studies show that people get more money in their pockets if they hire an attorney.

CNN’s Anderson Cooper 360 did a report entitled “Insurance Companies Fight Paying Billions in Claims,” which was televised on February 07, 2007. http://www.cnn.com/CNN/Programs/anderson.cooper.360/blog/2007/02/insurance-companies-fight-paying.htmls. On this show, they investigated how insurance companies work hard to keep accident victims like you from collecting billions of dollars

In this investigation, CNN looked at the case of Roxanne Martinez. When her car was hit in she had medical bills and lost wages of $25,000.  The insurance company offered her only $15,000 to settle. Roxanne decided to hire a personal injury attorney. They took Allstate to court and  a jury awarded Roxanne $167,000, which it felt she was entitled to receive.

Author and law professor, Jay M. Feinman, says that 10 out of 12 insurance companies work on the principle of what he calls the 3 D’s “Delay, Deny, and Defend” in order to save their companies money. According to Feinman’s book, this method was first introduced in the 1990′s as a way for insurance companies to cut their costs and make more money.
According to Feinman, the insurance companies found that they could make even more by denying legitimate claims as well.  http://www.delaydenydefend.com/

Insurance Companies Use 3D Approach to Lower Your Claim

Here is how the 3D process works:  If you are hurt in a minor accident, the agent will usually delay handling your claim, deny that you were even hurt, and even possibly defend their decision in a court battle.  The ultimate goal is to discourage you from hiring representation and to force you to take a small first-time offer http://www.youtube.com/watch?v=IvPW087RiJ8s.

CNN Obtained the Allstate training manual.  In that manual adjusters were instructed to force “smaller walk-away settlements.” Allstate understood that people will often be talked into taking their first offer and the smallest amount of compensation possible, even if it was not enough to cover their expenses.

How does these reports effect you if you get in a car accident, or a slip and fall? Without an attorney to protect you and advise you of their rights, you might join the millions of people who walk away from billions of dollars that insurers keep for themselves.  Cash that rightly belongs to the injured parties as compensation for their injuries. http://www.cnn.com/CNN /Programs/anderson.cooper 360/blog /2007/02/insurance-companies-fight-paying.html.

Take this example.  You can recover general damages such as pain and suffering in addition to recovering your out-of-pocket expenses such as. medical costs and lost wages.  The claims agent might even off your some of these general damages.  What reports have shows, however, is that even after paying lawyer’s fees, a client can get a lot more money that the injured party will get on their own.   In other words, the benefits of hiring an attorney are much greater. (88 California Law Review 2421, 2000).

Average of 40% Higher Payout When Using An Attorney

According to the 1999 Consumer Panel Survey of Auto Accident Victims, “Paying for Auto Injuries,” those injured in various kinds of accidents received an average of 40% more money when hiring an attorney to represent them versus representing themselves – Insurance Research Council, 1999, pg. 45-52).

  2. Giving you assurance during the entire effort that everything will be taken care of.
  3. Staying on top of the insurance company to make sure they move the case forward and pay promptly

  1. I think it's interesting to point out that there is a trend of a higher payout when a lawyer is hired. I've met a lot of people that have fought insurance claims in court. The ones who had lawyers always got better settlements than the ones who did it themselves. I would definitely say that hiring a lawyer is worth it every time.
