Road-Rage Fisticuffs Leads to Lawsuit

bicycle-384566_1280After a Marin, CA man was found guilty of felony battery and misdemeanor assault this June, his victim has taken him to court again with a personal injury lawsuit. 58 year old Roman Laskowski has filed claims of assault and battery along with those of intentional infliction of emotional distress and negligence. The lawsuit also claims loss of consortium, and Laskowski’s wife is also listed as a plaintiff. The suit was filed recently, and Jeffery Smock, the perpetrator and defendant, is scheduled for sentencing in the criminal trial on September 9, 2015.

The incident occurred on April 16, 2014 when Smock says he was struck by the side mirror of Laskowski’s passing truck while riding his bike through Mill Valley towards the end of a three hour trip. Laskowski was driving home from his job as a carpenter nearby. After Laskowski allegedly hit Smock, he stopped at a traffic light. Smock caught up to him, at which point the altercation occurred.

While Laskowski claims that Smock reached through the open window of the truck to strike him, Smock claims self-defense, saying that he was attacked while trying to write down Laskowski’s license plate to report him for a hit-and-run. Laskowski’s lawyers say that Smock was in a violent rage during the altercation. Laskowski ended up suffering a concussion, broken nose, cuts and bruises and other injuries to his neck and back. Because of these injuries, the suit alleges that Laskowski has not been able to work, leading him to seek both general and punitive damages along with medical expenses, legal costs, and compensation for lost wages.
