Elyssa Cherney of the Orlando Sentinel writes, “For the first time in more than four years, ex-millionaire James ‘Bob’ Ward could leave prison an innocent man — for now. A Circuit Court Judge on Monday vacated Ward’s 30-year sentence for second-degree murder in the 2009 shooting death of his wife Diane, ordering a new trial. Ward has been incarcerated since 2011 following a jury conviction. Because of the new ruling, the 67-year-old former real-estate developer has a chance to go home. ‘Now that Bob’s conviction has been vacated by the court, he is presumed innocent and he should be released,’ said Miami attorney Sean Ellsworth, who has handled Ward’s appeals. ‘Our next step is to seek a bond.’ Monday’s decision held that Ward’s original trial attorneys erred by not objecting to evidence that commented on his right to remain silent. In other words, the jury shouldn’t have inferred guilt based on what prosecutors said Ward didn’t say. The Orange-Osceola State Attorney’s Office is appealing the ruling. In the decision, Circuit Judge Jenifer Harris, who presided over the original trial, awards the new proceedings because the mistakes of Ward’s attorneys had a ‘reasonable probability’ of impacting the case’s outcome.”
